End-User License Agreement (EULA)

This End-User License Agreement (“Agreement” or “EULA”) is between you (“User”) and AAQSoftware LLC (“Company”, “we”, “our”, or “us”) and governs your use of the Songuage mobile application (“Licensed Application”, “App”).

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not install or use the App.

This Agreement is supplemental to and incorporates Apple’s Licensed Application End User License Agreement (LAEULA). In the event of a conflict between this Agreement and the LAEULA, the LAEULA shall control.

1. License Grant

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use Songuage for personal, non-commercial, educational purposes strictly in accordance with this EULA.

You may use the App on any Apple device that you own or control as permitted by the Apple Media Services Terms and Conditions.

2. Restrictions

You agree NOT to:

• Copy, reproduce, modify, translate, or create derivative works of the App.
• Distribute, rent, lease, lend, sell, sublicense, or commercially exploit the App or its content.
• Attempt to extract or reuse:
  • Songs
  • Audio files
  • Artwork
  • Learning sheets
  • Lesson data
  • Speech evaluator tools
• Reverse-engineer, decompile, disassemble, or circumvent any App protections or digital rights mechanisms.
• Interfere with servers, APIs, or backend services.
• Share or reveal copyrighted content to others.
• Share paid subscription content, or share your account with other users.

Violation of these terms may result in immediate account suspension or termination.

3. Ownership

All rights, title, and interest in the App—including but not limited to:

• Songs and audio
• Artwork, covers, and posters
• Learning sheets and educational content
• Speech evaluator tools
• UI elements, code, and design
• Translations, dictionaries, and AI-generated language content

are and remain the intellectual property of AAQSoftware LLC and its licensors. Nothing in this Agreement transfers ownership rights to you.

4. Subscriptions & Payments

Some App features require an active subscription. By subscribing, you agree to:

• Apple’s in-app purchase policies
• Automatic renewal unless canceled
• No refunds after subscription activation (Apple handles refunds)

Subscription grants a license to use, not ownership of any content.

When your subscription ends, access to premium content is removed.

5. User Content

Any speech, recordings, or data created by you within the App remains stored locally on your device unless you manually back it up. The App does not upload your voice recordings or audio to any server.

6. Privacy Policy

Your use of the App is also governed by the Songuage Privacy Policy, available at: https://songuage.app/legal

7. Termination

This EULA remains effective until terminated by either party.

We may terminate your access without notice if you:

• Violate this EULA
• Misuse Songuage content
• Attempt to extract or copy copyrighted materials
• Share your subscription or account
• Violate laws using the App

Upon termination:

• You must cease using the App
• You must delete all copies
• Subscription fees are not refunded

8. No Warranty

Songuage is provided “AS IS” without warranty of any kind.

We do not guarantee that:

• Content is error-free
• The App will be uninterrupted
• Speech evaluator tools will always work
• Learning content will meet educational expectations

You use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for loss of data, lost profits, personal damages, or educational outcomes.
• We are not responsible for Apple, Google, or third-party misuse of native voice features on the device.
• Our total liability will not exceed the amount you paid to use the App during the past 12 months.

10. Rules for Child Users

Songuage supports children and toddlers, but:

• Parents/guardians are responsible for supervising usage.
• Children may not create accounts without adult approval.
• No account data is shared with third parties.

11. Content Restrictions

All content inside the App is copyrighted and protected. You agree not to:

• Export or copy songs
• Re-upload content to other platforms
• Use Songuage recordings in apps, websites, or social media
• Resell or distribute any App material

This includes audio files, covers, posters, learning sheets, translations, and dictionary content.

12. Modifications

We may update this EULA at any time. Your continued use of the App after updates constitutes acceptance of the modified Agreement.

13. Third-Party Terms

Use of Songuage may require acceptance of:

• Apple Media Services Terms & Conditions
• iCloud terms (if using backups)
• Google or Apple authentication services

14. Governing Law

This Agreement is governed by the laws of Oman, without regard to conflict-of-law rules.
